[News] Lee Soo-man Gives Lecture at Harvard Business School

Korean entertainment mogul Lee Soo-man gave a lecture at Harvard Business School over the weekend, according to his company SM Entertainment on Monday.

SM explained in a press release that Lee spoke about the entertainment industry as representative of Asian showbiz market and "keynote speaker" at the Asia Business Conference, held Saturday at Harvard's Burden Auditorium.

The singer-turned-entrepreneur talked about the changes in the entertainment business in Asia during his lecture titled "Don't try to cut your ears!", referring to how legendary artist Vincent Van Gogh cut off his ear and stating that the painter could have created even more influential art if he had not done so.

He also emphasized the need for a new educational system to foster the growth of the human resources for the rapidly changing future, saying that "extraordinary talent who thinks in uncommon and abnormal ways" should be nurtured as leaders.

Lee is said to have received a big applause from some 700 attendees at the event, which was the 19th annual business conference sponsored by the Asian clubs of Harvard Business School, Harvard Kennedy School and Harvard Law School.

The Asian clubs focus on inviting prominent figures in Korea, China, Japan and other Asian countries to give lectures on the financial and political aspects of the business world.

The producer has given lectures at Harvard for three consecutive years, from 2006 thru 2008, and was also invited to MIT Sloan School of Management and Johnson School at Cornell University, where he spoke about "The Global Strategy of Hallyu" in 2008.

Lee, 57, started his music career in the 1970s as a singer of Korean pop band April & May and released his first of several solo albums in 1983.

He established SM in 1995, which quickly became one of the most influential talent agencies in Korea. He has created and masterminded the successful careers of numerous K-pop artists including BoA, Girls' Generation, SHINee, Super Junior and TVXQ.

[News] Fair Trade Committee Investigating All Celebrities In SM

The Fair Trade Committee (FTC) has launched an investigation regarding all the celebrities associated with SM Entertainment (SM) regarding the accordance of their contracts to the FTC's regulations and many fear that a 'Second TVXQ dispute' will arise.

According to the office of Jo Mun Hwan (member of the Grand National Party). the FTC has instigated an investigation of the contracts of 53 artistes of SM including Girls Generation, Super Junior and TVXQ, whose three members (Xiah Junsu, Micky Yoochun, YoungWoong Jaejoong) are locked in a legal dispute with the agency.

According to the written answer submitted to the office of Jo Mun Hwan by the FTC, the reason the TVXQ dispute is taking so long to be handled is because the FTC is currently investigating the contracts of all the SM artistes.

However, the FTC did not state a concrete finish date when it stated, "This dispute has not been completely processed because the Fair Trade Committee is currently investigating to see if the contracts of all the artistes of SM Entertainment are not in accordance with the regulations that have been set." and "We will carefully examine all relevant documents and process this case as soon as possible.

SM Entertainment, one of Korea's top entertainment agencies, has been plagued by misfortune the past year with three members of TVXQ and Super Junior's Hangeng filing lawsuits for unlawful contracts. The three members of TVXQ and Hangeng both gave reasons of a 13 year contract and unlawful income division for the legal disputes.

SM is not the only agency with problems regarding unlawful contracts of celebrities. Congressman Jo criticized the problems with unlawful contracts of celebrities last December at the Fair Trade Committee's parliamentary inspection of the administration, and called for the investigation of 407 agencies including large agencies such as SM Entertainment. However, it was found that only 11 agencies have corrected their contracts till the end of January, one month past the due date of the inspection.

Before this, in an inspection of 20 agencies including YG Entertainment and Star Empire in April~May of last year, it was found that 230 celebrities of 19 agencies all had unlawful clauses in their contracts.

Not only were there clauses regarding free of charge appearances at agency-run events, there were numerous clauses regarding notification of location, impossibility of retiring and other privacy related clauses that clearly violated human rights.

Director Lee Soo Man, who is also the creator of SM Entertainment, gave up his administrative powers on February 25th and stated that he would stay the major shareholder and a producer. This, all well as the inspection being held by the FTC, may put SM Entertainment in a dilemma.

This inspection from the FTC may mean a new chapter for large entertainment agencies such as SM as well as JYP Entertainment, that is caught up in the 'Jaebeom incident', in order to protect the rights of the 'powerless' celebrities. It may also eliminate the deeply rooted 'slave contract' from the Korean entertainment industry once and for all.

[News] SM Entertainment discontinues supply of music content to Mnet.com

SM Entertainment has recently announced that they will not be providing Mnet with its music source in the future.
There was an announcement posted on SM Entertainment official homepage on 2nd March with the title “Official stand regarding discontinuation of music source provision to Mnet”
In the announcement it was stated, “It has been confirmed that Mnet, with whom we have been discussing of long-term music source provision early this year, has violated the contract with our company. They were found with unauthorised use of SM contents on the ASP sites under Mnet.com and Mnet Media.”
It was added, “That was also no notice or explanation from Mnet about this. All this while, SM has been providing its contents to Mnet Media based on mutual trust. With that it will be hard to continue the business dealings which is based on good faith, and we have decided to give up on the contract with Mnet Media.” explaining the reason why songs by SM singers will not accessible via Mnet.com.
In fact, if one is to click on the song ‘Oh!’ by So Nyeo Shi Dae currently up #1 on Mnet realtime chart, a notice will pop up saying “We are currently in the midst of consulting on contract to using this music source. We will work hard to resume the service.”

[News] Hankyung’s contract termination court session to begin in 2010, will regain freedom earliest by March [Updated]

Sina Entertainment
December 30th afternoon, recently SJ(M) leader Hankyung’s contract termination lawsuit against SM has created an uproar after the media reported of the issue. Sina Entertainment has contacted Hankyung’s case representative Attorney Lee this afternoon for an exclusive dialogue, Attorney Lee revealed that Hankyung has submitted a plead for ‘Effective Suspension of Contract Agreement’ and ‘Contract invalid litigation’ to the court. It is learned that court session will be held on January 8th 2010 in South Korea. To prevent SM from using the delay tactics, Hankyung has especially put forth an “Effective Suspension of Contract Agreement’ plead, if the court approves of the agreement, the earliest Hankyung will regain freedom is by March 2010.
Court session for appeals submitted by Hankyung to commence on January 8th
Lately there are conjectures regarding Hankyung’s lawsuit against SM, Hankyung’s Chinese representative Attorney Lee accepted an exclusive dialogue with Sina Entertainment this afternoon, giving an official statement on this matter for the first time. Attorney Lee revealed that Hankyung has recently submitted two applications to the Seoul Central District Court, including ‘Effective Suspension of Contract Agreement’ and ‘Contract Invalid Litigation’. Made up of both Chinese and Korean attorneys, the attorney group has began collecting evidence for each application, and combining with past celebrities’ termination cases with SM for defence preparation. Court session will officially commence on 8th January next year in Seoul Central District Court, Hankyung himself will not be present, and the attorney group will be representing him in court. Attorney Lee expressed that as this case is more complex by nature, therefore it is not possible to predict the chances of winning now.
Regaining freedom as early as March 2010
According to Korean Law, when the plaintiff made a contract invalid litigation, proceedings usually need to go through a three-step trial; the first trial, second trial and third trial. The first and second trials need a period of 4-8 months each, while the third trial has no explicit period, it may even take more than 8 months. In order to prevent SM from using the delay tactics, Hankyung has applied for the ‘Effective Suspension of Contract Agreement’ to the Seoul Central District Court at the same time, ruling for this plead would be known as early as March or April 2010. This also means that if the appeal is successful, Hankyung would be able to regain freedom in advance by March 2010.
Temporary refused to come into contact with the company while resting
The media has reported the various unfair clauses in Hankyung’s contract with SM previously, Attorney Lee expressed agreement that the media’s surmise has “a certain degree of basis.” He revealed that at the moment Hankyung is resting and will not attend any performing activities for now. On one hand Hankyung himself has felt that his body is not well and needs some time to recuperate, not coming into contact with the company is due to trepidation of the arising of unnecessary disputes; on the other hand as he has already submitted the lawsuit to the court, the relationship with the company has somewhat became awkward, if Hankyung were to attend activities arranged by SM, this may cause unnecessary surmises to arise, therefore his attorney group has advised him to not attend any activities organised by SM temporarily. As for advertisements, Attorney Lee expressed that if it is not together with SJ, he may consider accepting if the shooting is only him alone.

[News] SM denies using Hangeng, SJ Beijing Concert will still be held

SM denies using Hangeng, SJ Beijing Concert will still be held
Super Junior’s Chinese member, Hangeng’s request of the termination of his contract has caused an uproar. There have been rumors that SM entertainment is using Hangeng to cause a publicity stunt for the Beijing concert and also that Hangeng may not be attending the concert. Due to these rumors, Net Ease Music Channel on the 29th has had an exclusive interview with the representative for the Beijing concert. The representative claims that everything has been going as planned and has not received any news about Hangeng not attending the concert.
Earlier, Korean group Super Junior-M (known as SJ-M)’s leader Hangeng sued SM Entertainment, to terminate his contract because of the unfair terms. Therefore it has been concluded that Hangeng will not be participating in any SJ-M’s schedule this year. According to Korean news site, Newsen, 57% of the fans who voted, support Hangeng leaving and becoming a solo, while 24% wishes he would not leave SJ. The soon to begin Beijing concert is in a nerve wrecking situation as it is in the preparing stage. The representative has reported: “Everything is fine, the hotel, airplane tickets, the concert tools are all being prepared on schedule.” When asked about the tickets for the concert, the representative also responded with a smile of confidence and that everything is fine.
About the rumor SM entertainment is using Hangeng for the Beijing concert next year, the representative responded saying “This is not true, the tickets are already sold out, so there would be no need to do such thing. Even so, there is no need to pull such a low publicity stunt, if Hangeng quits SJ, in the future, if he continues being an idol, this will affect his image.”
When the reporter asked the representative, “If Hangeng was to be absent for the concert would a lawsuit be filed against him?” The representative said, “We did not think about this because everything has been going on as planned.” The concert will be presented on time for the fans.

[News] SME Debunks News Of Henry Defending Hangeng

T/N: Translating all Hangeng VS SME articles, as they might be a reference point to JSC's case in future.

Media says Henry going solo; SM says: "We did not accept any interview."

[Sohu Korean Entertainment News] After the media reported on Hangeng's termination of contract with his management company last Monday, every media's prime concern has been whether or not SJ-M's activities in China can continue.
Previously, there were media reports on "Henry defending Hangeng" and "Henry going solo". Through an exclusive telephone interview with SM Entertainment, they stated that they did not accept any media interview.

The following is the transcript of SM Entertainment's statement:

With regards to the XKB (Guangzhou) report, "Henry defends Hangeng", that was released on 30 December 2009, our company, as a party involved, has not accepted any interviews ever since we arrived at the event location (29 December 2009). The organisers, Guangdong Television and Dongguan Broadcasting Corporation also did not schedule any interviews for us. Thus,
these are ficticious and inaccurate news by the reporters.

T/N: The following is a translation of the news article that SM debunked.

Henry defends Hangeng

Yesterday, Henry, from Korea's super popular group SJ-M, appeared in Dongguan to attend the "激情动漫嘉年华" festival as a performing artist. Due to the recent contract controversy that SJ-M's leader, Hangeng, is having with SM Entertainment, it was inevitable that Henry was asked questions relating to the issue. When the interview shifted to how there was a member of SJ-M that called Hangeng "lower than an animal", Henry said, "People who curse others are the ones that are lower than animals!"

On the night of 30 December, Sohu China's International Festival will be held at Dongguan Cultural Centre, Guangdong Television and 6 other mainstream broadcast channels will be broadcasting this 'live'. SJ-M member Henry, will be forming a last minute duo with Chinese national Zhang Li Yin, to perform at the festival.

With regards to the leader Hangeng's contract conflict with the company, Henry, who is also Chinese, took an obvious stance, siding with Hangeng. He revealed to the reporters that in order to avoid the company and the media, Hangeng turned off his mobile phone and pretended to go missing. He said, "Hangeng needs time alone to think through things calmly, but he's doing well right now, so the fans who are worried for him, please be reassured." When the reporter mentioned that there was a SJ-M member who called Hangeng "lower than an animal" earlier on, Henry's exp
ression changed and he couldn't help but gave an outburst of, "People who curse others are the ones that are lower than animals!" This made the reporters who were at the scene even more suspicious that there is already internal discord amongst the SJ-M members.

When asked whether SJ-M will attend Hunan TV's New Year's Eve Festival that is to be held on 31 December, Henry said helplessly, "To be honest, it all depends on the results of the talks between the company and Hangeng. It is useless to speak of the other guesses."

[News] SM to face hefty compensation if Hankyung were to miss Hunan TV’s New Year Eve Concert

During Hunan TV New Year Eve Concert last year, Chen Chusheng’s silent departure became the biggest storm of 2009 created by an artist.
Hunan TV’s 2010 New Year Eve Concert in Shenzhen next week may yet again face the “missing gate” embarrassment. This concert’s heavy-weight guest performer SJ-M member Hankyung is in the mist of terminating his contract with his management company.
Recently, after Hunan TV communicated with the management company, the other party expressed that the problem is not big. But the reporter was told that the possibility of Hankyung making the trip is silm.

Hankyung’s management company claims no problem

The New Year Eve (Concert) sponsor is also unable to find Hankyung, can only contact the management company. It is revealed that at the moment the answer Hankyung’s management company gave is that SJ-M attending should not be a problem. According to this optimistic estimation, the direction group’s arrangement for Hankyung and co is: SJ-M takes a plane to Shenzhen, to reach the airport at around 10 in the morning that day, rehearsals at 11am at the venue. The direction group is looking at Li Yuchun and Hankyung to perform together at midnight.

Industry analyzed Hankyung’s trip as slim

If Hankyung doesn’t come, will Hunan TV New Year Eve Concert accept a “depleted” SJ-M? One of the staff at the direction group expressed that SJ-M has always appear as a group, and leader Hankyung is the core (of the group). “The New Year emphasizes on reunion, if Hankyung is not there, we are not able to accept.” As both parties have already signed the performance contract, if SJ-M cannot appear at the last minute, SJ-M’s management firm would face a compensation. In accordance with the general practice of breach of contract, the indemnity is double (of the agreed amount). If things turns out so, SJ-M’s management company will face a 7-digit payment claim.
Source: Xiao Xiang Morning News
  • Follow-sjm.cn reports: SJ-M is confirmed to participate in Hunan TV’s New Year Eve Concert on December 31st, (they) will not participate in the Happy Valley Event on January 1st (Hankyung absent)
  • Sina Reports:  SJ-M, led by Hangeng is luckier than Rain (mentioned at the first part of original article). Our reporter understood from Tudou website’s (tudou.com) manager that Tudou used high prices to get the rights for online streaming to broadcast the end of year countdown concert by the 3 main channels, Shen Chuan TV, Jiang Su TV and Dong Fang TV. At the same time, they also invited the highly popular Hu Nan TV to stream their end of year countdown event online. There had been high expectations of SJ-M’s performance on the countdown event. Due to Hangeng’s contract problems with SM entertainment and in order to prevent their image from being overly discussed online, Hunan TV gave up Tudou website’s offer to stream the countdown event online. Hunan TV also limited the exposure of the countdown event on other websites. Hoping that Hangeng can successfully appear at the countdown event, Hunan TV gave up a 6 digit offer for the online streaming rights.

[news] Hu Nan TV Does Not Accept Henry & Zhang Li Yin Replacing The Group

Hu Nan TV does not accept replacement group

SJ-M still has a final performance for the year that is the Hu Nan TV Countdown Concert performance on the 31st and the reporter has learnt from one of Hu Nan TV’s staff that for SJ-M to appear at the concert as a whole group would prove to be a great feat. He said that before Han Geng’s contract termination issue has been settled, SJ-M would be unable to perform together as a whole. And when SM suggested it they could let Henry and Zhang Li Yin replace SJ-M, they did not agree as the audience had wanted to see Han Geng the most. In conclusion, they would not give up till the last minute ( for the whole of SJ-M to perform that night ).

As a result of SM company’s last minute changes, one of the local performance coordinators says that for him to inviting all seven SJ-M members requires 150 000 dollars of performance fees, while inviting Henry and Zhang Li Yin only requires 50 000 dollars.

SJ-World Admin received an email from kangteuk.com.cn (which is a popular Chinese website for Leeteuk and Kangin ㅡ currently inaccessible), and this is what they stated: If you come across news articles claiming that six members of Super Junior filed lawsuits against SM Entertainment: it’s an unconfirmed rumour.

This gossip has been presented in various forms, one of the most pular ones is that the webmasters of three major Super Junior fansites (Wannabe, Yuri9doo, and a Donghae fansite) witnessed the aforementioned Super Junior members filing said lawsuits.
If the rumour eventually turns out to be true, what we know fur sure though is that this information did not come from Wannabe or Yuri9doo.

Another version of this rumour quotes a fan who goes by the name of mybaby as the source; members of kangteuk.com.cn contacted mybaby and were assured that she never said anything about this rumour.

[news] "TVXQ has been monitored in private", Japanese media

Japanese media revealed that while filming the latest PV in December, members of TVXQ were being forced not to communicate with each other.
SM Entertainment however responded that this is no evidence that they (SME) are monitoring the members in private.

On December 22, 2009, a Japanese weekly women magazine (Women's Self) stated that during the activities in Japan, the communication between TVXQ's has been forbidden and monitored since 3 of the members has filed a lawsuit against SME.

The magazine also wrote that during the activities in Japan, the members were unable to perform well as one. Though all of the members stayed in one room, there was a screen separating them into 3 - 2. Thus, this act seems to forbid interaction between members and to observe their actions. The same situation occurred while they were filming for the PV of their upcoming Japanese single, Break Out. Though the MV was filmed in Japan, there were staffs following them to disallow communication between members.

With regards to this, SME's representative replied via phone, "The article by Women's Self is purely rumour. It is creepy to have this thought that the members are being watched closely. Furthermore, we are in the generation where communication devices are everywhere. This could happen in the 1990s but in today's situation; monitoring them (TVXQ) is implausible and impossible. "
